PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY USING THIS WEBSITE AND/OR PLATFORM, YOU AGREE TO BE BOUND BY ALL OF THE BELOW TERMS AND CONDITIONS AND THE PRIVACY POLICY.

1. Introduction

Fastpro Finance Private Limited ("Company"), operating under the brand name Maestera ("Maestera", "We", "Us", or "Our", as applicable), operates a digital music education platform including its website, mobile applications, and related services (collectively referred to as the "Platform").

The Platform connects music educators—including individual teachers, academies, institutes, schools, and other entities—with students seeking music education services.

For the purposes of these Terms:

  • Associate means any individual or entity engaged by the Company in any capacity, including but not limited to teachers, instructors, trainers, contractors, consultants, or representatives.
  • User, You, or Your refers to any person accessing or using the Platform.
  • Child refers to any User below the age of eighteen (18) years.

If the User is a Child, a parent or legal guardian must create and manage the account, provide consent for use of the Platform, and supervise all activities. Any unsupervised or off-platform interaction between a Child and an Associate is strictly prohibited and must be reported immediately. The Company reserves the right to suspend access, terminate accounts, and take appropriate action where required.

2. Acceptance of Terms

By accessing or using the Platform or availing any Services, You agree to be legally bound by these Terms and the Privacy Policy available on the Platform. If You do not agree to these Terms, You must immediately discontinue use of the Platform.

If You are a parent or guardian providing consent for a Child's use of the Platform, You agree to be bound by these Terms on behalf of the Child.

3. Description of Services

Maestera facilitates music education services by enabling interactions between Users and Associates through the Platform. The Company acts solely as a technology and facilitation provider and does not itself deliver instructional services unless explicitly stated.

The Platform may include scheduling tools, payments, recordings, communication systems, learning resources, and other supporting features.

To access Services, Users may be required to create an account and provide personal information, including but not limited to:

  • Name, contact details, and location
  • Age and date of birth (for verification purposes)
  • Parent or guardian details for Child accounts

4. License to Use the Platform

The Company grants You a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for personal, non-commercial educational purposes.

All rights not expressly granted are reserved by the Company. The Company may suspend or deny access to the Platform, in whole or in part, at its sole discretion.

5. Intellectual Property Rights

All content on the Platform—including curriculum structures, text, graphics, videos, audio, logos, trademarks, designs, software, and other materials—is owned by or licensed to the Company and is protected under applicable intellectual property laws.

You shall not copy, reproduce, distribute, publish, modify, or commercially exploit any Platform content without prior written consent from the Company.

Any recordings of sessions, where permitted, may be used only for personal learning purposes and must not be shared, distributed, or monetized in any form.

6. Payments and Refunds

All payments for Services must be made exclusively through the Company's authorized payment systems.

Refunds, if applicable, shall be limited to Services not rendered and shall be governed by the Company's refund policy. The Company shall not be responsible for delays, errors, or failures caused by payment gateways, banks, or third-party service providers.

Any free trials or promotional offers shall also be governed by these Terms.

7. User Content and Recordings

Users may submit content including feedback, reviews, media, or recordings.

You expressly consent to the recording of live sessions for quality assurance, training, auditing, and internal purposes. Where explicit consent is obtained, the Company may use recordings or submitted content for promotional or educational purposes.

The Company reserves the right to remove or restrict content at its discretion and does not assume responsibility for User-generated content.

8. Communication Policy

By using the Platform, You consent to receiving communications from the Company via email, phone calls, SMS, WhatsApp, push notifications, or other channels for service-related updates, transactional information, or promotional communications.

All communication between Users and Associates must occur only through Company-approved channels. Any off-platform communication is strictly prohibited, and the Company disclaims all liability arising from such interactions.

9. Code of Conduct

Users agree not to:

  • Share personal contact details or initiate off-platform communication
  • Upload misleading, offensive, illegal, or harmful content
  • Circumvent Platform safeguards or security features
  • Misuse the Platform for non-educational or commercial purposes

Violation of this section may result in suspension or termination of access.

10. Associate Disclaimer

Associates are independent service providers. The Company does not control or supervise conduct outside the Platform and disclaims vicarious liability to the maximum extent permitted by law.

Any issues arising from an Associate's conduct must be reported immediately through the Platform.

11. Limitation of Liability

The Platform and Services are provided on an "as is" and "as available" basis.

To the maximum extent permitted by law:

  • The Company shall not be liable for indirect, incidental, special, or consequential damages.
  • The Company does not guarantee educational outcomes, lesson quality, or uninterrupted access.
  • Aggregate liability, if any, shall not exceed the amount paid by You to the Company for Services during the relevant period.

12. Third-Party Services

The Platform may integrate third-party tools or services. The Company shall not be responsible for disputes, losses, or issues arising from third-party services.

13. Amendments

The Company reserves the right to amend these Terms from time to time. Continued use of the Platform constitutes acceptance of the revised Terms.

14. Termination

The Company may suspend or terminate access for violation of these Terms. Users may terminate their agreement by discontinuing use of the Platform.

Termination shall not affect accrued rights or obligations.

15. Indemnity

You agree to indemnify and hold harmless the Company, its directors, officers, employees, and agents from any claims, damages, or expenses arising from Your use of the Platform or violation of these Terms.

16. Severability

If any provision is found unenforceable, the remaining provisions shall remain valid and enforceable.

17. Assignment

Users may not assign their rights under these Terms. The Company may assign its rights without restriction.

18. Waiver

Failure to enforce any provision shall not constitute a waiver of that provision.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, and courts in India shall have exclusive jurisdiction.

20. Dispute Resolution

Any dispute shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996.
